
Terms & Conditions
1. Payment Terms
Payment is due within 14 business days of the invoice date unless otherwise agreed in writing. Late payments will incur a fee of 5% of the outstanding balance, plus interest charged at 8% per annum (pro rata), in accordance with the UK Late Payment of Commercial Debts (Interest) Act 1998.

2. Accepted Payment Methods
Bank transfer or any method agreed in advance. Bank details will be provided on the invoice.

3. Deposits
To secure a booking, a non-refundable deposit of £50 (or 25% of the total fee, whichever is greater) is required. No session is considered confirmed until the deposit is received. The remaining balance is due according to the payment terms above.

4. Cancellations & Rescheduling
Cancellations must be made at least 48 hours in advance. Cancellations within 48 hours may incur a £100 fee. Clients may request one reschedule, provided it is made more than 48 hours in advance.

5. Licensing & Usage
Images are licensed for personal or commercial use as outlined in your agreement. Copyright remains with James Harding Photography unless otherwise stated in writing. Images must not be resold, edited, or redistributed without written consent. Unauthorised commercial use may result in legal action.

6. Delivery
Final images are delivered digitally within 14 working days unless otherwise agreed. High-resolution JPEGs are provided unless specified. RAW files are not included unless agreed in writing. We aim to deliver faster whenever possible.

7. Image Retention
Images will be stored for a minimum of 6 months from the delivery date. After this period, they may be deleted without notice. Archival retrieval after 6 months may incur a storage fee.

8. Refunds
Deposits are non-refundable. Full payments may be partially refunded only in cases where no service has been delivered, and cancellation terms are met. No refunds are available after the shoot is completed, except in cases of service failure or breach of agreement.

9. Client Responsibilities
Clients are responsible for arriving on time and ensuring the location is ready for shooting. Any delays caused by the client may shorten the session or result in additional fees.

10. Revisions & Edits
One round of basic edits is included unless otherwise stated. Additional edits or revisions outside the original scope will be charged at £45/hour.

11. Re-Shoots / Retakes
Re-shoots required due to client-related issues (e.g. no-shows, dissatisfaction with personal appearance, location changes) will be charged at the standard session rate. Photographer error or technical failure will be corrected at no extra cost.

12. Model Release / Promotional Use
Clients grant permission for James Harding Photography to use selected images for portfolio, website, and promotional purposes unless stated in writing prior to the session. Clients may opt out by written request before the shoot.

13. Force Majeure
Neither party shall be liable for failure to perform due to unforeseen events such as illness, extreme weather, or government restrictions. Sessions will be rescheduled where possible.

14. Liability & File Loss
James Harding Photography is not liable for loss or damage to delivered files once transferred. It is the client’s responsibility to download and securely store their files.

15. Travel Expenses
Costs such as fuel, parking, rail fares, bus fares, tram fares, taxi fares, tolls, and accommodation (if required) will be quoted and agreed upon in advance. All travel will be arranged with efficiency and fairness in mind. Where extensive travel is required, a day rate of £250 may apply to cover travel time, particularly for shoots requiring a full day away from base or involving overnight stays.

16. Client Conduct
All clients and guests are expected to behave respectfully. James Harding Photography reserves the right to end any session immediately, without refund, in the event of abusive, threatening, unsafe or discriminatory behaviour.

17. Scope of Work
Each session includes an agreed number of edited images. Any additional requests (e.g. extra images, RAW files, specialist edits) must be agreed upon and quoted separately.
​
18. Legal Protection
Unauthorised use, reproduction or manipulation of images will be pursued under the Copyright, Designs and Patents Act 1988. Legal action may be taken against infringement.
